This story makes the mother out to be either overprotective or sue crazy. Kids play dodgeball and they are bound to get hit by the ball, this is just part of the game. But a Michigan mother is taking this common occurrence out of the schoolyard and into the courtroom.
“Cameishi Lindley was shocked when she got a call from Wayne County Juvenile Court on Wednesday. It was about her 10-year-old son, Bryce.
The soon-to-be fifth grader is charged with Aggravated Assault, following a schoolyard game gone wrong.
“These kids are basically playing a game we all have played,” Lindley told 7 Action News.
According to a police report, another student was struck in the face with a ball. That student’s mother asked that we not use her or her son’s name, but told 7 Action News he has a medical condition that makes head injuries especially dangerous.
“He sustained facial issue damage to his face. He had a black eye and a bruised nose,” the other parent said.
Medical records showed the then-fourth grader also suffered a concussion.”
Bryce received a suspension for hitting the unnamed student in the head.

“The case, Wayne County’s assistant prosecuting attorney Maria Miller tells Yahoo Lifestyle, “was evaluated by our Juvenile Prosecuting Unit, and it was determined that there was enough evidence to for us to charge aggravated assault.”
Critics, however, have called out the charge as overly harsh and racist”
“Now, because the boy being punished is black and the boy who was injured is white, some critics are calling the incident racist, while others — including celebrity comedian DL Hughley, who called the charge “ridiculous” — are coming to the boy’s general defense.
“Some 10 year olds were playing dodgeball on the playground at school. A white kid got hit with the ball. Then they charged the 10 year old Black child with assault,” tweeted film producer and self-dubbed “No. 1 race baiter” Tariq Nasheed. “This is why we should not prioritize any of these border issues, while our kids are racially targeted.”
This is all on the presumption that it was during the game. The mother claims that her son was hit in the face after the game was over. If that’s true, he was being bullied. I don’t think that is necessarily sue-worthy, but it should be noted that he is not complaining about being hit during the game at least. Bryce should apologize and that should be the end of the story. This unknown kid probably needs to stay away from things like dodgeball, if he is so prone to head injuries.
